Several states in the U.S. have passed comprehensive data privacy laws. These laws generally define personally identifiable information as "information that is linked or reasonably linkable to an identified or identifiable individual." But, there are exceptions to this definition.
All of these states have exceptions to the definition of personally identifiable information. Some states have an exception for "information … lawfully made available to the general public … from widely distributed media." The term widely distributed media, though, is not defined.
We have written a law review article, Privacy in the Age of Active Sensors, that examines the privacy impact of active sensors. In the piece, we raise the question whether posting a lawfully collected active sensor data set to its own website meets the widely distributed media exception. This is that website.
Below is a LiDAR dataset over some houses in Pacific Palisades, CA. One image above is a 3-D view of aerial imagery from Los Angeles county overlain on the terrain surface. The other images is a 3-D view of the LiDAR points overlain on the imagery. This dataset came from NOAA Digital Coast.
